DBA ANIMAL RESCUE ASSOCIATES OF ILLINOIS AND/OR ANIMAL RESCUE OF ILLINOIS
LIABILITY WAIVER and
RULES, REGULATIONS AND CONDITIONS FOR VOLUNTEERS, ANIMAL FOSTERS, ADOPTERS, MEET & GREETS, BOARDING PARTICIPANTS, PUBLIC, ETC.
WITNESSETH:
IN CONSIDERATION of the mutual covenants and agreements herein stated, Participant hereby provides the following waivers regarding participation in the adoption process and/or boarding program and/or Animal Foster Home (all hereafter “adoption process”) with and at the facilities or agents facilities of Animal Rescue, and does expressly acknowledge and agree to the following:
1. Participant acknowledges that involvement in the animal adoption/rescue process exposes participant to certain risks, including but not limited to risk of physical injury and/or death, as well as possible damage and loss to property, and potential economic loss, including those which may be incidental as well as consequential, the aforesaid stated risks not intended to be all inclusive of such potential hazards;
2. Participant hereby expressly agrees to assumption of all risks whatsoever, whether or not they are directly or indirectly associated with participation in the adoption process, including but not limited to those associated with participation in any and all activities connected with Animal Rescue during the animal adoption process, including all realized as well as unrealized, express as well as implied risks;
3. Participant acknowledges an understanding that the participation may expose the participant to animals and their un-predictability and that they may expose participant to risk from such animals, expressly acknowledges said risks and fully assumes the risk, known or unknown which may or may not be actually contemplated by Participant;
4. The undersigned participant does hereby fully release and discharge Animal Rescue, its officers, agents, servants, employees, attorneys and all other personnel from any and all claims from injuries, including death, damages, or loss whether personal or economic on account of or relating to participation in the adoption process, same applying whether or not participant actually fosters or adopts any animal;
5. The undersigned participant further indemnifies and holds harmless and defends Animal Rescue, its officers, agents, servants, employees, attorneys and all other personnel from any and all claims resulting from injuries, including death, damages, or losses whether personal or economic, sustained by Participant and arising out of, connected with, or in any way associated with any participation in the adoption process.
6. It is further agreed and understood that by submission of any foster application, application for adoption or any other application with Animal Rescue, the undersigned agrees to waiver of any and all liability claims against Animal Rescue, its officers, agents, servants, employees, attorneys, and all other personnel from any and all claims from injuries, damages, or loses whether personal or economic, sustained by Participant.
7. Express release of Liability of Animal Rescue by Participant:
The Participant, for and in good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does release, acquit, and forever discharge, and by this instrument does release, acquit and forever discharge ANIMAL RESCUE, individually, and together with its heirs, administrators, personal representatives, successors, assigns, employees, attorneys and agents, of any and all claims, demands, causes or caused of action, damages, costs, expenses, compensation and the like which are now or may hereafter be brought on account of or arising from, directly or indirectly, any matter, occurrence, cause or thing relating to Participants’ involvement in the animal adoption and/or animal foster home and/or boarding program, by and between ANIMAL RESCUE and Participant, and fully indemnifies and holds harmless Animal Rescue from any and all claims brought or which might be brought against Animal Rescue as a result of Participant involvement, and as otherwise relates to the parties hereto.
